Welcome to Hello Pixel. By using our website or working with us, you agree to these terms. If you don't agree with them, please do not use our site or hire us for your project.


SECTION A: WEBSITE TERMS OF USE

1. Intellectual Property & Website Use

We own the code, designs, and content on this website. You are welcome to browse our site for your personal, non-commercial use, but you cannot copy, resell, or republish our work and pass it off as your own.

2. Cookies

We use standard cookies to help our website run smoothly and to see how visitors interact with it. By using our site, you agree to our use of cookies.

3. Linking to Our Site

Reputable organisations (like search engines, government agencies, or professional directories) may link to our website. However, we reserve the right to ask you to remove a link to our site at any time, and you agree to take it down immediately if we ask.

4. Public Comments & Feedback

If any part of our website allows comments or public input, we don't screen them before they go live. Comments belong entirely to the person who wrote them. We aren't legally responsible for what users post, but we reserve the right to remove anything inappropriate or offensive.


SECTION B: DESIGN & DEVELOPMENT SERVICES

5. Package Scope & Clear Boundaries

Your project features and pricing are strictly determined by your chosen tier ('Starter', '3-Page Site', 'Business', 'Catalogue', or 'Shop'). You cannot purchase a lower tier and patch it together with add-ons to build a higher-tier site. If project requirements scale up mid-stream, it will automatically shift to the appropriate tier.

5b. Hosting & Maintenance Packages

To keep your website secure, online, and performing optimally, we offer hosting and maintenance. These are billed monthly according to your selected plan.

Migration & Third-Party Handovers: If you choose to migrate the website code to an independent hosting provider or hand it over to a third-party developer, Hello Pixel is completely released from any ongoing technical support, maintenance, or performance guarantees.

5c. Optional Add-On Menu

Any services requested outside your project scope will be treated as add-ons and billed separately. These may include, but are not limited to:

  • Additional revision round (billed at our flat rate of R1,500 per round).
  • Additional custom web pages (billed at our flat rate of R1,500 per page).
  • Copywriting (billed at our flat rate of R1,500 per page, or based on our copywriting service rate starting from R375.00 per hour).
  • Additional products beyond the initial 10 products included in the 'Pro' tier (billed at R150 per product via our spreadsheet template).

All add-on services must be approved in writing and require a separate 50% deposit before implementation begins.

6. The Two-Stage Revision Policy & Feedback Windows

To keep your timeline on track, your website includes two structured rounds of revisions tied to specific review windows:

  • Stage 1 (The Wireframe): We deliver your wireframe layouts first. You have 5 business days from delivery to review them and send us one consolidated round of changes to adjust copy, fonts, layouts, and structure. Once you sign off on this design or the 5-day pass, the structure is locked so we can start building the code.
  • Stage 2 (The Code): Once your site is built on our private testing server, a final 5-business-day window opens. This round is strictly for sending us a consolidated list of minor adjustments like changing colours, swapping in final images, or testing.

How the windows work: Once you send your feedback list within the 5 days, your window for that stage closes while we make the updates. If you want to change layout structures, move content blocks, or redesign parts of the site after the Stage 1 wireframe is locked, it requires rewriting the code. This will bypass your standard layout exclusions and trigger an out-of-scope fee of R1,500 per round.

7. Sending Us Content

We work best when we have everything together. We cannot accept images, text, or feedback sent in scattered pieces over messaging apps or separate emails. All text, final high-quality images, and assets must be sent to us in one single, complete batch (via a shared link or a single email).

If you are utilising our optional copywriting add-on, your "complete batch" of content includes completing the copywriting drafting process and receiving your final written sign-off on the copy before the project timeline countdown begins.

Your revision windows will only open once we have received your complete collection of content (and copy sign-off, where applicable). Additionally, your final images must match the shapes and layouts approved in Stage 1. If we have to structurally rewrite the website code to fit completely different image shapes, an out-of-scope fee of R1,500 will apply.

8. Timeline & Inactivity

Your project timeline officially starts once we have 100% of your website content, text, images, and your deposit payment is cleared.

We want to launch your site quickly! When we send you a design mockup or a live testing link, you have a 5-business-day review window to give us your feedback. If no feedback or communication is received within 7 full business days of delivery, the project will be automatically paused and removed from our active workspace calendar. To reopen a paused project, a mandatory R1,500 reactivation fee will apply to secure a new opening in our development schedule.

9. Rush Deadlines

If you need your project delivered on an accelerated timeline (5-7 business days), a flat fee of R2,500 applies. This rush service is only available for our 'Starter', '3-Page Site' and 'Business' packages.

Because of the advanced security setups, databases, and payment testing required, 'Catalogue' or 'Shop' packages cannot be rushed under any circumstances.

10. Payment Terms

We break our payments down into two simple milestones:

  • A 50% non-refundable deposit is required before we book your slot and start any design work.
  • The remaining 50% balance is due immediately after you review and approve the live testing link, and before we transfer the site to your live domain or make it public.

We reserve the right to pause design work, turn off access to the testing link, or hold your live launch if an invoice is overdue.

11. Content Ownership & Legal Responsibilities

You must make sure you have the legal right, ownership, or permission to use all text, logos, and photos you give us for the website. We are not responsible for any copyright disputes regarding assets you provided.

You are completely responsible for providing the exact text for your legal compliance documents, including your Privacy Policy, Terms of Service, or specific cookie disclaimers required by local laws (such as POPIA).

12. Ownership Rights & Cancellation Policy

Once your final project invoice is paid and cleared in full, 100% of the operational rights, designs, and code transfer to you. We retain the right to showcase screenshots and links of your completed website in our design portfolio and marketing materials, unless otherwise agreed upon in writing.

Because we reserve dedicated time on our calendar for your project, deposits are strictly non-refundable. If you choose to cancel the project before we begin coding, the contract is terminated, and you will not owe anything further. However, if you choose to cancel the project after the coding phase has commenced, the remaining 50% balance will become due in full immediately to cover the resources expended.


SECTION C: LIABILITY & DISCLAIMERS

13. Disclaimers

We build our websites using robust standards. However, because the digital landscape changes quickly, we cannot guarantee that the website will be completely uninterrupted by future third-party software changes, browser updates, or unexpected hosting server downtime beyond our control.

14. Limitation of Liability

As far as the law allows, Hello Pixel will not be held liable for any loss of business profits, data issues, or financial losses caused by project delays due to late content delivery or client inactivity. Our total liability under this agreement is limited to the amount you paid us for the services.
